By accessing our Website, submitting a photo for restoration, or purchasing our services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our services.
1. Description of Services
OldPhotoRescue.com provides digital photo restoration, repair, enhancement, colorization, and related digital imaging services (collectively, the "Services"). We manipulate digital copies of photographs provided by you to improve their visual quality.
2. User Representations & Image Ownership (Copyright)
By submitting any photograph, digital file, or image (collectively, "User Content") to us, you represent and warrant that:
You are the rightful owner of the copyright to the image, or you have obtained explicit, lawful permission from the copyright owner to grant us the rights to modify, repair, and reproduce the image.
The User Content does not infringe upon the intellectual property rights, privacy rights, or publicity rights of any third party.
The User Content does not contain illegal, defamatory, or highly offensive material. We reserve the right to refuse service for any image that we deem inappropriate or in violation of applicable laws.
You retain full ownership of your original User Content. By submitting it to us, you grant OldPhotoRescue.com a temporary, non-exclusive, royalty-free license to use, host, store, modify, and reproduce the image solely for the purpose of fulfilling your requested Services.
3. Payment, Revisions, and Refunds
Pricing: Prices for services are as stated on our Website or provided to you via a custom quote. We reserve the right to adjust pricing at any time.
Payment: Payment must be made in full before final, high-resolution, un-watermarked restored images are delivered, unless otherwise agreed upon in writing.
Revisions: We strive for complete customer satisfaction. We provide (2) rounds of minor revisions based on your original instructions. Requests for completely new restorations or major changes outside the scope of the initial request may incur additional fees.
Refunds: Due to the custom, labor-intensive nature of digital restoration, all sales are final once final files are delivered. If you are unsatisfied with a watermarked proof, please contact us to discuss revisions.
4. Limitation of Liability
To the maximum extent permitted by law, OldPhotoRescue.com, its owners, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or sentimental value, resulting from:
Your use of or inability to use our Services.
The loss or corruption of any digital files submitted to us.
Any unauthorized access to or use of our secure servers and/or personal information stored therein.
Our total liability for any claim arising out of or relating to these Terms or our Services shall not exceed the total amount paid by you to us for the specific service in question.
5. Portfolios and Marketing
Unless you explicitly request otherwise in writing at the time of submission, you grant OldPhotoRescue.com permission to use "Before and After" comparisons of your restored images on our Website, social media, and marketing materials to demonstrate the quality of our work. We will never display sensitive personal text or identifiers without your permission. If you prefer to keep your family photos entirely private, simply notify us, and we will respect your request.
6. Indemnification
You agree to defend, indemnify, and hold harmless OldPhotoRescue.com and its operators from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms, including any third-party claims of copyright infringement related to images you submitted.
7. Governing Law
These Terms and any dispute arising out of your use of the Website or Services shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law principles.
