TERMS OF SERVICE

Last Updated: July 1,2026

Welcome to OldPhotoRescue.com (the "Website"). These Terms of Service ("Terms") govern your access to and use of the website, services, and products provided by OldPhotoRescue.com ("we," "us," or "our").

By accessing our Website, submitting a photo for restoration, or purchasing our services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our services.

1. Description of Services

OldPhotoRescue.com provides digital photo restoration, repair, enhancement, colorization, and related digital imaging services (collectively, the "Services"). We manipulate digital copies of photographs provided by you to improve their visual quality.

2. User Representations & Image Ownership (Copyright)

By submitting any photograph, digital file, or image (collectively, "User Content") to us, you represent and warrant that:

  • You are the rightful owner of the copyright to the image, or you have obtained explicit, lawful permission from the copyright owner to grant us the rights to modify, repair, and reproduce the image.

  • The User Content does not infringe upon the intellectual property rights, privacy rights, or publicity rights of any third party.

  • The User Content does not contain illegal, defamatory, or highly offensive material. We reserve the right to refuse service for any image that we deem inappropriate or in violation of applicable laws.

You retain full ownership of your original User Content. By submitting it to us, you grant OldPhotoRescue.com a temporary, non-exclusive, royalty-free license to use, host, store, modify, and reproduce the image solely for the purpose of fulfilling your requested Services.

3. Payment, Revisions, and Refunds

  • Pricing: Prices for services are as stated on our Website and will be provided to you via a custom quote. We reserve the right to adjust pricing at any time.

  • Payment: Payment must be made in full before final, high-resolution, un-watermarked restored images are delivered, unless otherwise agreed upon in writing.

  • Revisions: We strive for complete customer satisfaction. We provide (2) rounds of minor revisions based on your original instructions. Requests for completely new restorations or major changes outside the scope of the initial request may incur additional fees.

  • Refunds: Due to the custom, labor-intensive nature of digital restoration, all sales are final once final files are delivered. If you are unsatisfied with a watermarked proof, please contact us to discuss revisions.

4. Limitation of Liability

To the maximum extent permitted by law, OldPhotoRescue.com, its owners, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or sentimental value, resulting from:

  • Your use of or inability to use our Services.

  • The loss or corruption of any digital files submitted to us.

  • Any unauthorized access to or use of our secure servers and/or personal information stored therein.

Our total liability for any claim arising out of or relating to these Terms or our Services shall not exceed the total amount paid by you to us for the specific service in question.

5. Portfolios and Marketing

Unless you explicitly request otherwise in writing at the time of submission, you grant OldPhotoRescue.com permission to use "Before and After" comparisons of your restored images on our Website, social media, and marketing materials to demonstrate the quality of our work. We will never display sensitive personal text or identifiers without your permission. If you prefer to keep your family photos entirely private, simply notify us, and we will respect your request.

6. Indemnification

You agree to defend, indemnify, and hold harmless OldPhotoRescue.com and its operators from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms, including any third-party claims of copyright infringement related to images you submitted.

7. Governing Law

These Terms and any dispute arising out of your use of the Website or Services shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law principles.

8. Changes to Terms

We reserve the right to modify these Terms at any time. Any changes will be posted directly on this page with an updated "Last Updated" date. Your continued use of our Website or Services following the posting of changes constitutes your acceptance of the revised Terms.

9. Contact Information

  1. Add a Consent Checkbox: When building your website or embedding your chatbot assistant/order form, consider adding a mandatory checkbox during the file-upload or checkout process that says: "I agree to the Terms of Service and certify that I own or have permission to use the copyright for these images." This adds an extra layer of legal protection for your business.

  2. The Final Checkout or Order Submission Form

Because your service involves clients uploading family heirlooms and copyrighted material, placing it only in the footer isn't quite enough for maximum legal protection. You need explicit consent before they hand over an image.

    • Where to put it: Right next to the "Submit Quote Request," "Upload Photos," or "Place Order" button.

    • How it looks: Use a small checkbox that the user must click before they can submit their images.

    • [ ] I agree to the [Terms of Service] and certify that I own or have permission to modify these images.

    • (Note: Make sure the words "Terms of Service" are a hyperlink that opens your ToS page in a new browser tab so they don't lose their place on your order form).

Inside your Chatbot Assistant (If Applicable)

If you are using an AI chatbot or a support widget to gather customer details or project files, it's a great idea to build a quick acknowledgement into the chat flow.

      • Before the bot asks the user to upload their vintage photo, it can display a brief note: "To protect your memories and respect copyright laws, by uploading an image you agree to our [Terms of Service]."

4. Handling of Physical Materials (If Applicable)

If you permit clients to mail physical photographs, include this section. If you operate 100% digitally, you can remove it.

  • While we take the utmost care in handling physical photographs sent to us for scanning and restoration, you acknowledge that sending items through the mail carries inherent risks.

  • We highly recommend sending items via tracked and insured mail carriers.

  • OldPhotoRescue.com is not responsible for items lost, delayed, or damaged in transit to or from our facility. In the unlikely event that a physical photograph is damaged or lost while in our direct possession, our liability is strictly limited to the cost of a blank replacement medium or a refund of the service fee paid. We cannot be held liable for the sentimental or historical value of the original media.

The Terms of Service (ToS) page should be placed where it is legally protective but completely out of the way of your main website design.

Here are the standard best practices for placing the ToS on your website:

1. The Global Footer (Most Important)

The absolute standard for any professional website is to place a text link to your Terms of Service in the footer (the very bottom section of your website).

  • Why: The footer repeats automatically on every single page of your site. This ensures that no matter where a potential client lands (the homepage, a gallery page, or a blog post), the terms are legally accessible to them.

  • How it looks: Usually in a small, clean font next to your copyright notice. For example:

  • © 2026 OldPhotoRescue.com | [Privacy Policy] | [Terms of Service]

Recommended URL Structure

When you create the actual page in your website builder (like Hostinger, WordPress, etc.), keep the URL simple, clean, and predictable:

  • www.oldphotorescue.com/terms OR www.oldphotorescue.com/terms-of-service

A quick tip for your layout: You can hide this page from your main navigation menu (the top header bar). You want your header to focus purely on converting visitors—like Home, Services, Gallery (Before/After), Pricing, and Contact. Keep the legal paperwork tucked neatly in the basement (the footer)!

https://oldphotorescue.com/privacy-policy

Implementation Tip:

Just like the Terms of Service, create a standalone page for this (e.g., www.oldphotorescue.com/privacy-policy) and link to it in your website's global footer right next to your ToS link. This keeps your site compliant with major privacy standards while keeping the main navigation focused on your restoration work.
